Moving to the United States under an E2 visa is an exciting opportunity for entrepreneurs and their families. While the E2 visa spouse can enjoy significant benefits, many families eventually begin asking a bigger question: Can this temporary visa lead to permanent residency?

While the E2 visa provides excellent benefits, it is a nonimmigrant visa—it does not directly lead to a green card.

Although the E-2 is a non immigrant visa and does not provide a direct path to a green card, careful planning can open future immigration opportunities. Understanding your rights as a spouse, available work privileges, and long-term immigration strategies can help your family make informed decisions.

A bona fide enterprise refers to a genuine, active commercial business that produces goods or services for profit. The business cannot be a marginal enterprise, meaning it must have the present or future capacity to generate more than enough income to support the investor and contribute to the U.S. economy.

Whether investing in an existing business or launching a new venture, the principal investor must demonstrate operational control over the investment enterprise and remain actively involved in directing its operations. This control may be exercised through ownership, management, or another qualifying corporate device or other corporate device permitted under applicable regulations.

Rights of an E2 Visa Spouse

One of the biggest advantages for an E2 visa spouse is the ability to work in the United States. Current immigration law provides automatic work authorization for eligible spouses in E status.

In other words, work authorization is generally employment authorized incident to the spouse’s lawful E status, eliminating the need to file a separate application solely for employment permission.

While many spouses still choose to obtain an Employment Authorization Document (EAD) for administrative convenience or employment records, employment eligibility is generally recognized as work authorization incident to valid E status.

This benefit allows an E-2 spouse to:

  • Work for almost any U.S. employer
  • Start and operate their own business
  • Accept full-time or part-time employment

What About Children?

However, unlike the dependent spouse, unmarried children generally do not receive automatic work authorization. They may attend school in the United States while maintaining lawful nonimmigrant status, but they cannot accept employment unless they qualify under another immigration category.
