The EB-5 Immigrant Investor Program continues to evolve in 2026, with significant developments affecting visa availability, USCIS adjudication, compliance requirements, and investor timelines. For prospective investors, understanding these changes is essential to securing permanent residence in the United States while avoiding unnecessary delays.

The latest updates centre on the May 2026 Visa Bulletin, increased scrutiny by U.S. Citizenship and Immigration Services (USCIS), the approaching September 2026 grandfathering deadline, and renewed political discussion surrounding the future of the programme.

Here’s everything investors need to know.

What Is the EB-5 Immigrant Investor Program?

The EB-5 Immigrant Investor Program allows eligible foreign nationals to obtain U.S. permanent residence (a Green Card) by making a qualifying investment in the U.S. economy that creates or preserves at least 10 full-time jobs for American workers.

Current minimum investment amounts remain:

  • $800,000 for investments in a Targeted Employment Area (TEA), including Rural projects, High-Unemployment Areas, and Infrastructure projects.
  • $1,050,000 for investments outside designated TEAs.

These thresholds remain unchanged under the EB-5 Reform and Integrity Act (RIA).

Good Moral Character Reviews Becoming Broader

USCIS has also updated its approach to assessing Good Moral Character (GMC).

Rather than focusing solely on the statutory review period for naturalisation, officers may now assess the totality of the circumstances, including conduct and financial compliance that predates an investor’s five-year conditional residency period.

Although this policy primarily affects future citizenship applications rather than the initial EB-5 petition, investors should maintain accurate financial records and ensure ongoing legal compliance throughout their immigration journey.


EB-5 Filing Fees Under Legal Challenge

Recent federal court decisions have found that USCIS unlawfully increased certain EB-5 filing fees without completing a required fee study.
