How an E-2 Spouse Documents Work Authorization
Before starting work, retrieve the spouse’s most recent Form I-94 and confirm that the class of admission is E-2S and the record is unexpired. For Form I-9, an unexpired E-2S Form I-94 can serve as List C evidence of employment authorization when presented with an acceptable List B identity document. A valid Employment Authorization Document may instead be used as a List A document, but an EAD is not required when acceptable E-2S evidence is available. If the I-94 does not show the correct spouse designation, obtain case-specific guidance before relying on it as work-authorization evidence.

- Study: An unmarried child under 21 may attend school, college or university while in valid E dependent status.
- Employment: A child is not work-authorized based solely on E dependent status.
- Age-out planning: Derivative eligibility ends if the child marries or reaches age 21. Review any independent status or immigration option well before that event and before the current Form I-94 expires.
Important Considerations
- Principal and family status: Dependent E status generally depends on the principal maintaining E-2 status and on the qualifying spouse or parent-child relationship continuing.
- Separate documents and deadlines: Each family member should check their own visa for travel and their own Form I-94 for the authorized period of stay. A child should review an independent option well before marriage, age 21 or the I-94 expiration date; another status is not automatic.
- Permanent residence: E-2 dependent status is temporary and does not itself provide a green card. A family member seeking permanent residence must independently qualify through an applicable immigrant category.
