In September 2025, the U.S. government issued a sweeping executive order overhauling aspects of the H-1B visa program. The changes are among the most dramatic in decades—and they’re already sending ripples through tech, healthcare, academia, and immigration law.

Here’s a breakdown of what’s changed, why it matters, who’s impacted, and where the biggest uncertainties still lie.


What the New Executive Order Does

The proclamation is officially titled “Restriction on Entry of Certain Nonimmigrant Workers”. Among its central provisions:

  • For new H-1B petitions filed after 12:01 a.m. Eastern Daylight Time on September 21, 2025, a one-time fee of $100,000 must accompany the petition
  • It restricts the entry of foreign nationals in H-1B status if their petitions are not accompanied by this fee.
  • The order is scheduled to last 12 months, through September 21, 2026, unless extended or modified.
  • The order does not apply to:
      • petitions filed before 12:01 a.m. on September 21, 2025
      • renewals of existing H-1B statuses
      • current visa holders’ travel in and out of the U.S. (as per the FAQ) 
  • The proclamation also calls for rulemaking reforms:
      • The Department of Labor is to revise prevailing wage levels for H-1B jobs. 
      • The Department of Homeland Security is to create a system that prioritizes high-paid / high-skill petitions when demand exceeds supply (i.e. non-lottery weighting). 
  • A “national interest” exemption can be granted in certain cases—meaning some employers or petitions might be exempted from the $100,000 requirement if deemed critical to U.S. interests.
